In Section 1, we questioned the evidence for iteration of tenses, even with abstraction. To permit abstraction would in any case risk neutralizing our distinction between tensed and untensed sentences. Sequence of tense phenomena, far from supporting iteration, were incompatible with it. Instead, we argued, tense always retains its full deictic character; tenses never have scope over each other. The future modal WILL is exceptional (Section 2), but abstraction is not required to deal with this.An important suggestion, first made in (...) Section 1 and developed further in Section 3, would restrict quantification induced by the interpretation of Past to a domain determined by pragmatic factors. When Past serves as a reference time, e.g. when it forms part of would, as inSam believed that he would be in BostonJames bought a stamp that would be priceless then a previous occurrence of Past serves to define the domain relevant to the quantificational element of Past. Without semantic binding or reference, the two cases of Past in such sentences will thus be satisfied by the same interval in the past.The extension of this idea in Section 3, permits an account of the supposed incompleteness of the past tense without invoking a hidden THEN in e.g. I turned the lights off. In this case, restriction of the relevant domain does not proceed via an earlier occurrence of Past but depends solely on discourse factors.In Section 4, the analysis of have given in Part I is modified to introduce an element of ‘pastness’. The relevant sub-interval must be non-final-and perhaps need not even be a sub-interval of the evaluation interval itself. Empirically necessary, this change makes the incompatibility of Pres,have and a definite adverb like at 6 o'clock in a single sentence even harder to explain semantically. However, the vague restrictions on domain imposed by the present tense and relevant to the sub-interval required by an embedded have below it seem clearly pragmatically incompatible with the explicit restriction of that same interval to a very specific interval in the past — a restriction which, we argue, is imposed by a definite time adverb.Thus, Part II represents a consistent, though entirely informal plea for the embedding of the semantics of Part I in a framework in which pragmatic considerations can interact freely with the semantics, to restrict the domains within which quantification is permitted. It is in effect a plea for the introduction of partial models along the lines suggested by Barwise and Perry (1981). The advantages of the basic distinctions between tense, aspect and adverbs introduced in Part I would, we have suggested in the second part, be yet more obvious in such a framework. In Religious Experience and the Knowledge of God, Harold Netland advances a critical-trust approach to religious experience. This approach raises important questions about what Michael Martin has called “negative religious experiences.” Netland responds by attacking Martin’s “negative principle of credulity,” but I argue that Netland’s response can be undermined if we take negative religious experiences not as experiences of God as absent, but as experiences of the world as godless. On this understanding, there is no need for a negative principle (...) of credulity; the ordinary principle still applies and puts pressure on Netland’s response. I then raise concerns with Netland’s “argument from fulfilled expectations,” even as part of a cumulative case argument. Ultimately, I propose that careful attention to the impact of Christ on our Western moral framework might help to resolve both concerns. (shrink)

As a candidate Donald Trump Sovereigntystyled himself uniquely equipped to enact the will of a thickly racialized national community. His campaign may thus be read alongside Carl Schmitt’s key concepts: the friend/enemy distinction fundamental to politics, a popular sovereignty founded in an organically united Volk. But what of Trump’s presidency? Here, too, Schmitt’s thought is helpful, particularly his work on commissarial dictatorship as a response to a state of emergency—we will read in this light the “Muslim Ban” and the pardon (...) of Sheriff Joe Arpaio. Rather than creating new executive powers, this chapter argues that Trump is exploiting existing ones. This is inevitable: Presidents will seek to exercise the powers available to them, and the US Constitutional tradition fails to provide effective tools for distinguishing between the executive’s legitimate and baseless emergency actions. Schmitt’s thought and career are marred by precisely the same failure. (shrink)

This treatise on aesthetics begins by showing that the word "art" is used as a name not only for "art proper" but also for certain things which are "art falsely so called." These are craft or skill, magic, and amusement, each of which, by confusion with art proper, generates a false aesthetic theory. In the course of attacking these theories the author criticizes various psychological theories of art, offers a new theory of magic, and reinterprets Plato's so-called "attack on art," (...) showing that it has been entirely misunderstood. Eighteenth century river hydraulics used both theory and measurement to address problems of flood safety, navigation and defense related to the rivers. In the late eighteenth century the Dutch overseer of the rivers, Christiaan Brunings, integrated hydraulic theory and meteorological practices, which enabled him to design a unique instrument for measuring river flow. The question is whether the unprecedented detail of measurements fits the putative empirical stance in the eighteenth century. The interactions between theory, instrument, measurement, and other knowledge practices (...) are here assessed using experiences in similar measurement practices. I argue that Brunings had theoretical and embodied understanding of hydrodynamics, as he knew how to design an instrument for flow measurement of sufficient accuracy for his purpose in the sociopolitical context of river management. Ruth Macklin argued that dignity is nothing more than respect for persons or their autonomy. During the COVID-19 pandemic, difficult decisions are being made about the allocation of scarce resources. Respect for autonomy cannot justify rationing decisions. Justice can be invoked to justify rationing. However, this leaves an uncomfortable tension between the principles. Dignity is not a useless concept because it is able to account for why we respect autonomy and for why it can be legitimate to override autonomy in (...) times of critical care resource shortages. Dignity affirms the worth of the human individual as a meaning-making embodied subject, who is always in relationship to others, the world, time, and transcendence, and who realizes their dignity through their moral behaviour. Such an understanding means people should be helped to make morally right decisions about their own treatment, which may include forgoing potentially beneficial treatment for the good of others. Respect for dignity does not require fulfilling the morally wrong choices of one who insists on treatment at the expense of others. Dignity also protects the discretion of clinicians to make decisions appropriate to their competence by prohibiting the application of broad-based criteria such as age. (shrink)

Rooting, defined as a spectator’s demonstrative encouragement of a contestant’s effort, ideally has the morally positive aspects of benevolent concern and helpfulness but in practice strains against reasonable standards of conduct by being rude, excessively biased, exploitative, fanatical, and superstitious. Rooting may activate an atavistic, morally cogent sense of fighting for one’s group that is at odds with the universalism of civilized morality. The ‘merely play’ excuse can cut both ways, deflecting moral objections but also removing moral credit from rooting. (...) Although rooting is often not humane, humane rooting can occur and is supported by humane commentary by sports participants, broadcasters, and journalists. Humane rooting supports the premise of benevolence theories (Mengzi, Hutcheson) that morally ideal benevolence has a foothold in an innate general benevolence – seen in this area especially in benevolence toward efforts. Being partisan, excited, and demonstrative, rooters cannot perfectly embody ‘universal calm benevolence’, but they can consciously minimize the inhumane aspects of rooting and achieve a more fully prosocial satisfaction. The Jewish leftist lawyer Ernst Fraenkel was one of twentieth-century Germany's great intellectuals. During the Weimar Republic he was a shrewd constitutional theorist for the Social Democrats and in post-World War II Germany a respected political scientist who worked to secure West Germany's new democracy. This book homes in on the most dramatic years of Fraenkel's life, when he worked within Nazi Germany actively resisting the regime, both publicly and secretly. As a lawyer, he represented political defendants in court. As (...) a dissident, he worked in the underground. As an intellectual, he wrote his most famous work, The Dual State – a classic account of Nazi law and politics. This first detailed account of Fraenkel's career in Nazi Germany opens up a new view on anti-Nazi resistance – its nature, possibilities, and limits. The role of mathematics in scientific practice is too readily relegated to that of formulating equations that model or describe what is being investigated, and then finding solutions to those equations. I survey the role of mathematics in: 1. Exact solutions of differential equations, especially conformal mapping; and 2. Simulations of solutions to differential equations via numerical methods and via agent-based models; and 3. The use of experimental models to solve equations (a) via physical analogies based on similarity of the (...) form of the equations, such as Prandtl’s soap-film method, and (b) the method of physically similar systems. Two major themes emerge: First, the role of mathematics in science is not well described by deduction from axioms, although it generally involves deductive reasoning. Creative leaps, the integration of experimental or observational evidence, synthesis of ideas from different areas of mathematics, and insight regarding analogous forms are required to find solutions to equations. Second, methods that involve mappings or transformations are in use in disparate contexts, from the purely mathematical context of conformal mapping where it is mathematical objects that are mapped, to the use of concrete physical experimental models, where one concrete thing is shown to correspond to another. This book makes an important contribution to ongoing efforts in the fields of medical law and bioethics to answer the challenges posed by the limitations of the principle of respect for autonomy, especially as these pertain to human research ethics. The principle of respect for autonomy seems to have become firmly embedded in human research ethics since its inclusion in the 1947 Nuremberg Code, which was a response to atrocities committed by Nazi doctors. Nonetheless, there is an increasing awareness of (...) the limitations of the principle of respect for autonomy and the underlying conceptualisations of human autonomy. (shrink)

This paper aims to interpret the role of the soul as ontological, intellectual or cognitive and as the moral principle within the frame of the holistic conception of human psychosomatic health that emerges from the context of Zalmoxian medicine in the proemium of Plato’s Charmides. It examines what the ontological status of the soul is in relation to the body and the body–soul complex of man considered as a psychosomatic whole. By comparing the presentation of the soul as principle in (...) the Charmides and the Phaedrus, the paper defends the thesis that in the former dialogue, Plato develops his own anthropological ontology, which paves the way for the salvation of human existence and health. The soul is bestowed with an ontological primacy that determines the philosophical and medical presuppositions for treating human illness under a holistic view. The interpretation of the ontological relation of the soul to the body and the entire human being in the context of Zalmoxian holistic medicine is based on Hermias Alexandrinus’ exegesis of the conception of the soul as principle in the Phaedrus. This paper demonstrates that, from both the medical holistic viewpoint and the anthropological philosophical perspective, the soul is the principle and πρῶτον with regard to the body and the body–soul complex without being the whole that the corresponding medical epistemology must apprehend. The approach used by physics is based on the identification and study of ideal objects, which is also the basis of biophysics, in combination with von Neumann heuristic modeling and functional fractionation according to R.Rosen is discussed as a tool for studying the properties of consciousness. The object of the study is a kind of line of analog systems: the human brain, the vertebrate brain, the invertebrate brain and artificial neural networks capable of reflection, which is a key property characteristic (...) of consciousness. Reflection in the broad sense of the word, understood as an internal representation of the external world, is characteristic of a wide range of animals, and some of them (bumblebees, fish) even demonstrate reflection in the narrow sense of the word, understood as an inner self-representation. This complex behavior is realized by miniature brains of ~1 million neurons. The use of simple recurrent neural networks (RNNs) to obtain answers to general questions is illustrated. For example, it has been shown a small RNS is able to pass delayed matching to sample (DMTS) test, forming an individual dynamic representation of the received stimulus, allowing decoding by a special external neural detector.. It has been demonstrated in the reflexive game “even-odd”, the RNS has a huge advantage over a multi-layered neural network, with the same and a larger number of neurons – reflection defeats regression. It was found that the asymmetry of outcomes in the odd-even game, which was explained by various causes, including psychological ones – “it’s easier to catch up than to run away”, is reproduced in the game of two RNNs. Obviously, there are no psychological causes here and the advantage of the player playing for “even” is explained by the more complex strategy of the “odd” player – he needs to predict the opponent’s move and choose the opposite one. Wittgenstein's principal works, the Tractatus Logico‐Philosophicus and Philosophical Investigations, are each written in such strikingly unconventional ways that it takes considerable effort to translate them into conventional philosophical writing. The most important aspect of Wittgenstein's style for an understanding of his philosophy is his use of multiple voices, and the way he forces his reader to engage with those voices in order to understand him. This chapter provides an outline of the leading macro‐level answers to the question which of Wittgenstein's (...) writings set out his philosophy, and which set out views he rejected. Wittgenstein's method of composition, revision, and rearrangement, leads from the remarks written down in his wartime notebooks, to a manuscript containing several stages of construction of the Prototractatus, and from there to the polished typescript of the Tractatus. The chapter illustrates how to interpret Wittgenstein's remarks without taking a position on questions about texts and style, voice and authorship. (shrink)

Twenty years ago in "Turing's Two Tests for Intelligence" I distinguished two distinct tests to be found in Alan Turing's 1950 paper "Computing Machinery and Intelligence": one by then very well-known, the other neglected. I also explained the significance of the neglected test. This paper revisits some of the points in that paper and explains why they are even more relevant today. It also discusses the value of tests for machine intelligence based on games humans play, giving an analysis of (...) some twentieth century TV game shows and how they relate to the tests for machine intelligence in Turing's paper and in some other tests for machine intelligence that have been proposed since. Their value in distinguishing between 'wise' and simply ‘clever’ AI is discussed. (shrink)

The ascendance of populism to power in various liberal democracies around the world triggered vigorous public debates. More often than not, scholars, politicians and analysts warn of the dangers populism poses to democracy and its institutions, expecting populism to turn authoritarian once in government. Viewing populism as a feature of the opposition alone, others argue that populism in government is not meant to last - but rather consolidated into the mainstream of political and party systems. This chapter provides a critical (...) overview of the literature on populism in power, putting into scrutiny dominant theoretical paradigms in the field of so-called populism studies. It discusses the multi-faceted trajectories populist actors globally may take in their transition from opposition to power. It concludes that distinct types of populist actors have distinct implications on democracy depending on factors such as ideology and context. (shrink)

In the history of political thought, the relationship between property and power has been a central preoccupation. The very nature of private property, on many accounts, is to put owners in a position of self-serving power to make decisions about matters of concern to others. In many legal systems, the vast power of owners is pervasive, as an ever greater range of resources is brought within the property regime and subjected to private power backed by the coercive power of the (...) state. Political and legal philosophers have long puzzled over how to reconcile the nature of private property with the limits and social responsibilities upon which, at least for some accounts, property’s legitimacy depends. The perennial question, then, is how best to understand the nature of property such that property’s limits can also be accounted for coherently within our legal and constitutional arrangements. Robé’s book Property, Power and Politics provides us with a wide-ranging analysis of property. There is much that we agree with and applaud here. In this contribution we seek to situate a key aspect of his work within this larger context, and to offer a criticism of one element of his view: his rejection of an understanding of ownership as an office. In Robé’s analysis, offices belong in the public sphere, where officeholders are held to account by their constituencies. We argue that Robé’s rejection of the idea of ownership-as-office rests on a misunderstanding of the legal concept of “office.” Moreover, this idea, properly understood, provides sound conceptual support for the normative aims of Robé’s account: to bind property and social responsibility tightly together. Robé’s project to criticize the virtually unlimited power of private owners in the contemporary world is served, not undermined, by understanding property as an office. First, we provide a brief summary of the key elements of Robé’s view of property (Part II). We then introduce a theoretical perspective on property as office as it has been developed in legal theory (Part III). Finally, we argue that this perspective fits better with Robé’s stated purposes than his own rejection of it suggests and raises some questions for future discussion (Part IV). (shrink)

An alleged moral right to informational privacy assumes that we should have control over information about ourselves. What is the philosophical justification for this control? I think that one prevalent answer to this question—an answer that has to do with the justification of negative rights generally—will not do.

The AGI alignment problem has a bimodal distribution of outcomes with most outcomes clustering around the poles of total success and existential, catastrophic failure. Consequently, attempts to solve AGI alignment should, all else equal, prefer false negatives (ignoring research programs that would have been successful) to false positives (pursuing research programs that will unexpectedly fail). Thus, we propose adopting a policy of responding to points of philosophical and practical uncertainty associated with the alignment problem by limiting and choosing necessary assumptions (...) to reduce the risk of false positives. Herein we explore in detail two relevant points of uncertainty that AGI alignment research hinges on---meta-ethical uncertainty and uncertainty about mental phenomena---and show how to reduce false positives in response to them. Our present crises are growing more urgent, pervading many domains of public life—economic, political, environmental, and social. This motivates scholars to find more adequate, combinatory perspectives from which to explain them. One such effort, under the broad heading of Law and Political Economy (LPE), challenges an established view of legality that insulates the market and its dominant actors from critique and accountability. The established view is based on two misconceptions. First, it sees the real function of a capitalist legal device, (...) whether in contracts, antitrust, property, or corporate law, in terms of efficient wealth creation; this function is its underlying rationale and normative aim. Second, it tends to remove equality, coercion, and legitimacy—the core problems of power—from the scope of economic appraisal. When laws and policies are fashioned out of these ideas, democratic institutions will be unable to counter the dominance of capital. New analytical approaches are therefore necessary (Purdy et al. 2020). Along with researchers in associated fields, LPE scholars are attempting to better understand the legal constructions in which financial and political power are anchored and to develop new ways of integrating the economy into democratic life. Robé is a leading voice in these debates. His new book, Property, Power, and Politics, encloses in one volume his ideas on the role of incorporated firms—and of markets, property, and finance—in the larger dynamics of global politics. In this symposium, interlocutors with backgrounds in law, political science, and philosophy engage with this rich analysis. This introduction provides an overview of the book’s arguments (sections 2 and 3) and then introduces the contributions (section 4). (shrink)

William Ockham and John Wyclif develop strikingly different accounts of the Eucharist in the light of strikingly different metaphysical assumptions. Ockham assumes that God can create or annihilate any other actual being without creating or destroying anything not a part of it and so that God can annihilate a substance while preserving its real accidents. Wyclif supposes that to annihilate a being is to annihilate not only its accidents but everything in its Porphyrian tree. Ockham takes being to be univocal, (...) Wyclif allows that there might be distinct ways of being. Both attempt to negotiate difficult terrain between their metaphysics and the theological orthodoxy of their time but with quite different results. While Ockham admits that consubstantiation (the co-presence of the bread and wine and the body and blood of Christ) is the most rationally defensible of the alternative accounts of the Eucharist available to him, he strives to develop an account both consistent with his metaphysics and with a plausible understanding of transubstantiation. Wyclif begins with a similar project but in the end concludes that consubstantiation is the best account of the Eucharist. (shrink)

To incorporate medical ethics into clinical practice, it must first be understood and valued by health care professionals. The recognition of this principle led to an expanding and continuing educational effort by the ethics committee of the Vancouver General Hospital. This paper reviews this venture, including some pitfalls and failures, as well as successes. Although we began with consultants, it quickly became apparent that education in medical ethics must reach all health care professionals—and medical students as well. Our greatest successes (...) came in the formative years of a medical career (ie, in medical school and residency training programmes), but other efforts were not wasted, particularly among nurses and other health care professionals.Although this is a personal review of the experience in one institution, the lessons learnt in Vancouver are applicable to the further development of medical ethics in the UK. Here I look to some work in the historical sciences in order to draw out some of the epistemic benefits of “speculative narratives,” which bears on some more general epistemic benefits of speculative reasoning. Due to the contingent nature of much historical evidence, some degree of speculative reasoning is necessary to get the epistemological ball rolling in the historical sciences, and I argue that speculative narratives provide the necessary sort of frameworking apparatus for doing precisely this. I use contemporary work (...) on the first peopling of the Americas (the “Clovis First Debate”) for illustration. (shrink)

This article explores children’s narrative identity formation and the impact of adult–child relationships on shaping a child’s narrative. The formation of identity in all children is vulnerable to a culture of ‘adultism’, wherein the authority wielded by adults can potentially subject children to abuse and neglect. Consequently, adultism has the aptitude to hinder the constructive development of a life-affirming identity in children. The primary objective of this article is to develop a childist narrative theology of praxis methodology, aimed at raising (...) consciousness and educating adults on both life-denying and life-giving ways of engaging in the process of children’s narrative identity formation.To achieve this goal, the methodology is developed by adapting Denise Ackermann’s ‘feminist theology of praxis’ to focus specifically on children. The application of feminist theory principles is deemed relevant to the social standing of children as it aligns with the broader goal of liberating oppressed groups, whether women or children. Additionally, John Wall’s work is employed to elucidate the terms ‘childist’ and ‘childism’ as interpretive frameworks. Positioned within the scientific domain of Practical Theology, this study seeks to transform conditions that impede human flourishing into opportunities for positive change.The research objectives determine that a literature review will be suitable to gather essential information for the formulation of a childist narrative theology of praxis. This review, characterised as explorative and descriptive, is conducted within the field of Practical Theology.Contribution: The significance of this study is underscored by its exploration and description of the pastoral functions of consciousness, awareness-raising, and education concerning adult–child relations. By scrutinising these pastoral functions, the emphasis is placed on the proactive, preventive, and universal aspects of pastoral care in the context of children, thereby contributing valuable insights to the discourse.
